1. DEFINITIONS AND INTERPRETATION
1.1 The definitions set out in the General Conditions apply to these Terms and Conditions. 1.2 These Terms and Conditions govern the contractual relationship between WiseShare and the Customer regarding the use of the Service.
2. SUBSCRIPTIONS AND PAYMENT TERMS
2.1 WiseShare offers Subscription Plans, details of which are available on our website. 2.2 Fees are due in advance and non-refundable except as expressly provided herein. 2.3 WiseShare reserves the right to adjust pricing, with prior notice to Customers.
3. CUSTOMER CONTENT AND RESPONSIBILITIES
3.1 Customers are solely responsible for the legality, accuracy, and confidentiality of their uploaded Content. 3.2 Customers warrant that they have all necessary rights and permissions to upload and share Content. 3.3 WiseShare may remove Content that violates these Terms and Conditions.
4. CONFIDENTIALITY
4.1 WiseShare will maintain the confidentiality of Customer Content, except as required by law. 4.2 Customers must not disclose confidential or proprietary information obtained through the Service to third parties.
5. DATA PRIVACY AND COMPLIANCE
5.1 WiseShare complies with applicable data protection laws, including the Tunisian Data Protection Law (Loi n° 2004-63 du 27 juillet 2004 sur la protection des données à caractère personnel). 5.2 Customers consent to the processing of their personal data as outlined in WiseShare’s Privacy Policy.
6. INDEMNIFICATION
6.1 The Customer agrees to indemnify and hold WiseShare harmless from any claims arising from the Customer’s breach of these Terms and Conditions.
7. DISPUTE RESOLUTION AND GOVERNING LAW
7.1 These Terms and Conditions shall be governed by the laws of the Republic of Tunisia. 7.2 Disputes shall first be resolved through good-faith negotiations; failing that, disputes shall be subject to arbitration in Tunisia in accordance with Tunisian arbitration laws.
8. MISCELLANEOUS
8.1 If any provision of these Terms and Conditions is found invalid, the remaining provisions shall continue in full force and effect. 8.2 These Terms and Conditions, together with the General Conditions and Privacy Policy, constitute the entire agreement between WiseShare and the Customer.
